1. In accordance with current legislation, defective Article(s) or items that do not correspond to the order will be refunded, provided they are returned to the Seller in the condition in which they were received, including all components, accessories and/or or integral parts, such as, for example: packaging, instruction manual, chargers, etc.

1.1. Exceptions are made for personalized products, sealed audio or video recordings and sealed computer programs, from which the consumer has removed the guarantee seal of inviolability after delivery.

1.2. By law, the consumer has the right to return the product (cancel the contract) within 14 days without incurring any costs.

1.3. The refund (including delivery costs) must be made within 14 days using the same payment method used by the consumer.

2. Since Pestiscos&Companhia is not a party to any purchase or sale made through the Marketplace, the guarantee obligations of the Article(s) are the sole responsibility of the Seller. Under no circumstances may Pestiscos&Companhia be called on to respond for any warranty obligation for the Article(s) sold.

3. By midnight of the second business day following receipt of the order, the Buyer must confirm receipt and conformity of the item(s) received in relation to the order.

4. The lack of this confirmation presumes the good reception and conformity of the item(s) with that ordered, without, however, assuming the conformity of the characteristics of the article with the characteristics that the Seller announced, maintaining therefore, the Buyer has the rights granted under the terms of Decree-Law No. 84/2021, of October 18th, namely:

4.1. 3-year warranty from the delivery of the item, except in the case of used movable property in which the warranty period is reduced to 18 months by express agreement between the Seller and the Buyer, under the terms and for the purposes of paragraph 3 of art. 12 of said Decree-Law, both parties being aware of such reduction and accepting it in a free, clear and thoughtful manner.

4.2. In case of lack of conformity of the good with the specifications of the Article, the Buyer is entitled to have it replaced free of charge, by means of repair or replacement, a proportional reduction in the price or the termination of the contract, under the terms of the articles, pursuant to articles 15 to 20 of Decree-Law No. 84/2021.
