Right of free resolution

1. The Buyer has a period of 14 days from receipt of the ordered Article(s) to exercise, vis-à-vis the Seller, its right of free withdrawal without payment of compensation and without needing to indicate the reason. .

2. The refund will be made within a maximum period of 14 days, except in cases where the Article(s) to be returned are not received within the same period or as long as the Buyer does not provide proof of return of the item.

3. Return expenses will be borne by the Buyer, except when the Article does not exceed 30kg in weight and has been shipped from mainland Portugal, the Seller assuming the cost of the return in cases that meet both requirements.

4. Within a period of 14 days from the date on which the Buyer has communicated his decision to terminate the contract, he must return the Article(s) in its original and complete condition, including components, accessories and/or integral parts , packaging, instruction manual, etc., and packaged in the same way as for shipment. Returns will not be accepted for Article(s) that do not comply with the provisions of this number, as well as if they show signs of misuse or whose handling exceeds what is normally accepted. at a commercial establishment.

5. The right of free withdrawal cannot be exercised in relation to:

5.1. Supply of goods or provision of services whose price depends on fluctuations in financial market rates that the supplier of goods or service provider cannot control and which may occur during the free termination period.

5.2. Supply of goods made according to the Buyer's specifications or clearly personalized.

5.3. Supply of goods that, by nature, cannot be sent back or are likely to deteriorate or quickly expire.

5.4. Supply of sealed goods that cannot be returned, for reasons of health protection or hygiene when opened after delivery.

5.5. Supply of goods which, after delivery and by their nature, are inseparably mixed with other Articles.

5.6. Supply of alcoholic beverages whose price has been agreed upon when the purchase and sale contract is concluded, whose delivery can only be made after a period of 30 days, and whose real value depends on market fluctuations that cannot be controlled by the Seller.

6. The Buyer exercises his right of withdrawal directly from the Seller.

 

Competence to resolve consumer disputes

1. In the event of a consumer dispute, defined in accordance with the provisions of Law No. 144/2015, of September 8, the consumer may resort to the competent alternative resolution entity for consumer disputes.

2. Without prejudice to the provisions of legislation, statutes and regulations to which alternative resolution entities for consumer disputes are bound, the consumer may opt for the European online dispute resolution platform available at https://webgate. ec.europa.eu/odr, by the alternative resolution body for consumer disputes in your place of domicile or by the alternative resolution body with specialized expertise, if any for the sector in question. You can consult the updated list of all alternative consumption resolution entities available at www.consumidor.pt.

3. If there is no entity(ies) for alternative dispute resolution pursuant to the provisions of the previous number or the existing entity(ies) is(are) not considered competent due to the value of the dispute, the consumer may resort to the Consumer Conflict Arbitration Center, located in Faro, with the email address: info@consumoalgarve.pt and available on the page https://www.consumidoronline.pt/pt/.
